Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and BellSoft India (OPC) Private Limited, the company that operates the Create QR service at https://createqr.in(the “Service”).

By accessing or using the Service, including by creating a QR code, signing up for an account, or scanning a QR code that resolves to a Create QR redirect, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

• You may create a free account by signing in with Google.
• You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
• You must provide accurate information and must not impersonate another person or entity.
• You may close your account at any time by contacting us. We may suspend or close accounts that violate these Terms.

Create QR provides tools to generate static and dynamic QR codes, customise their appearance, and (for dynamic QR codes) view aggregated scan analytics.

• Free tier: unlimited static QR codes, free video and image QRs (up to 1 GB total storage), and 1,000 signup credits — enough for 10 dynamic QRs in your first month. No watermark, full scan analytics on every dynamic QR.
• Paid tier: where introduced, the additional features and applicable fees will be clearly disclosed before you pay.

We may modify, suspend or discontinue any feature at any time. Where we discontinue a paid feature, we will provide reasonable notice and an appropriate refund if applicable.

You agree NOT to use the Service to:

• Violate any applicable law or third-party right (including intellectual property, privacy or publicity rights)
• Generate QR codes that link to malware, phishing pages, illegal content, child sexual abuse material, or content that incites violence or hatred
• Mislead the scanner about the destination of a QR code (e.g. impersonate a known brand, government or financial institution)
• Send unsolicited bulk messages, spam, or commercial communications through any feature of the Service
• Interfere with, disrupt, or attempt to reverse-engineer the Service, including by automated scraping, denial-of-service, or circumventing security measures
• Resell, sublicense, or repackage the Service without our prior written consent
• Use the Service in a way that imposes a disproportionately large load on our infrastructure

We reserve the right to remove QR codes, suspend accounts, and report illegal activity to law enforcement.

You retain all rights to the content you create through the Service (QR codes, destination URLs, uploaded logos, labels). You grant us a limited, worldwide, royalty-free licence to host, store and display your content solely for the purpose of operating the Service for you.

You represent and warrant that you have all necessary rights to the content you upload (including any logos or images you embed in a QR code) and that the content does not infringe any third-party rights.

The Service, including its software, design, brand name, logo, taglines (such as “Premium QRs for the classy you.”), text, graphics and the underlying technology, is owned by BellSoft India (OPC) Private Limited and protected by Indian and international intellectual property laws. These Terms grant you no right to use our trademarks except to identify the Service.

Where you purchase a paid plan, the following apply:

• Prices are shown inclusive of applicable Goods and Services Tax (GST) for Indian customers. International customers are responsible for any local taxes.
• Subscriptions renew automatically until you cancel. You can cancel at any time through your account settings.
• Refunds: we offer a 7-day no-questions-asked refund on first paid subscription. Renewals are non-refundable except where required by law.
• All payments are processed by our payment partner; we do not store full card numbers on our servers.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service to you becomes commercially unreasonable.

On termination: (a) your right to use the Service ends immediately, (b) any outstanding fees become payable, (c) provisions that by their nature should survive (Intellectual Property, Disclaimers, Limitation of Liability, Indemnity, Governing Law) will survive.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT QR CODES WILL SCAN IN EVERY ENVIRONMENT (PRINTING CONDITIONS, LIGHTING, DEVICES, NETWORK COVERAGE, ETC.).

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BELLSOFT INDIA (OPC) PRIVATE LIMITED, ITS OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) INR 5,000.

You agree to defend, indemnify and hold harmless BellSoft India (OPC) Private Limited and its officers, directors and employees from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of or related to (a) your violation of these Terms, (b) your misuse of the Service, or (c) your infringement of any third-party right (including IP and privacy rights) through your use of the Service.

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts at New Delhi, India.

Before initiating any legal action, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We will work in good faith to resolve the dispute within 60 days.

We may update these Terms from time to time. The “Last updated” date at the top of this page will change. For material changes, we will additionally notify you via email (if you have an account) or via a prominent banner on the site at least 14 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
